 Compliance with Terms and Conditions

1. You agree to be bound by these Terms and Conditions when you submit an Order to Dreamtime Kullilla-Art using the online Order Form.

 Registered Site Members

1. You may use the services provided on this website as a registered site member.

2. To become a member you must complete registration by providing your name and address, telephone number, a valid email address and nominate a password.

3. If you do not provide accurate and complete details we may not be able to activate your membership or supply products to you. You agree to keep your membership details current at all times by accessing your account via the website.

4. We only permit one registration per email address.

 Privacy

1. We undertake to take all due care with any information which you may provide to us when accessing our website. However we do not warrant and cannot ensure the security of any information which you may provide to us.  Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.

 Website Services

1. Unless otherwise stated, all prices are quoted in Australian Dollars (AUD) and where applicable, are inclusive of Goods and Services Tax (GST) for all sales within Australia.  We endeavour to ensure that all prices on our website are current. 

2. We reserve the right to amend our prices at any time.

 Ordering Process

1. You may place an Order through the Website by submitting the electronic Order form on the Website.

2. By completing and submitting the electronic Order Form, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract.

3. The receipt of an order number or an email order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell.

 Acceptance or Rejection of Order

1. Dreamtime Kullilla-Art reserves the right to accept or reject your Order.

2. In the event that we reject your Order we will notify you of this within five (5) Business Days after the placement of the Order.

3. Where we reject an Order and the payment has already been processed, we will refund any money paid to us in respect of that Order and make reasonable endeavours to process the refund within five (5) Business Days.

Order Cancellation Due To Error

1. Dreamtime Kullilla-Art makes every reasonable effort to ensure that we are presenting accurate information on our website.

2. In the event that a product is listed at an incorrect price or with incorrect description or image due to a typographical error or similar oversight, Dreamtime Kullilla-Art reserves the right to cancel the transaction whether or not the order has been confirmed and payment made to us.

3. If payment has been made to us we will immediately refund the amount paid by reversal of the initial payment. 

 Product Descriptions

1. We strive to ensure that our products are described as accurately as possible on our website; however we do not warrant that the description is accurate.  Where we become aware of any incorrect description, we reserve the right to correct any error or omission. 

2. Images have been provided for illustrative purposes only and we do not guarantee that any image will reproduce in true colour or that any given image will reflect or portray the full design or options relating to that product.

 Product Returns and Refunds

1. Our first priority is your satisfaction. If your item is faulty upon arrival or is not as described, we will gladly exchange the item or refund to you the value of the item.

2.  Returns are subject to us receiving the item back within 10 days of purchase. Items must be returned with their original packaging and, unless they were damaged prior to you receiving them, must still be in an unused and saleable condition.

 Freight and Shipping

1. When you order from us, we require you to provide your name, address for delivery, your email address, telephone contact and credit card details.  We undertake to take due care with this information; however in providing us with such information you accept that we are not liable for its misuse due to error in transmission or virus or malware.

2. Shipping charges apply as are set out on our website. We reserve the right to amend these charges from time to time.

3. Delivery of your ordered product/s will be as set out on our website.  Title in the goods passes to you when we have accepted your offer to purchase and payment has been received.  

 Insurance

1. Dreamtime Kullilla-Art takes no further responsibility for the delivery of the order (ie lost or damaged) once we have a receipted proof of postage if no insurance is selected.  We take every precaution to package the order carefully and sufficiently however we will not be responsible for any Third Party mishandling of orders.

 Import Duties

1. Some countries impose import duties on goods brought into that country. It is your responsibility to determine what duty or tax you may have to pay to your Government for the import of goods ordered from us. We are not responsible for any customs brokerage fees or import taxes.

 Availability of Goods

1. Although we strive to keep an accurate amount of stock on hand, you acknowledge that from time to time a product on our website may be unavailable due to unforeseen circumstances. We will endeavour to contact you within 5 business days to arrange a full refund, replace the item with a comparable piece in a similar price range or come to an alternative arrangement.

2. In the case of a full refund, the receipt of your refund will depend on the period of time it takes your financial institution to finalise the refund.

3. We reserve the right to remove any product displayed on our website from sale either temporarily or permanently at any time without notice.

1.  You can pay for your Order by any of the methods specified on the electronic Order Form on our website.

 Jurisdiction

1. These terms and conditions are to be governed by and construed in accordance with the laws of the Queensland and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in Queensland and you agree to submit to the jurisdiction of those Courts.

2. If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity.  If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.

 Indemnity 

1. By accessing our website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website. 

2. When you visit our website, we give you a limited licence to access and use our information for personal use.
